In the following Contract, the 'Photographer' shall mean 'Paulina Bieleninik' trading as 'Paulina Bieleninik Photography' or 'Paulina Be Photo'. The 'Client(s)' shall be those persons who will fill out booking form.
The client(s) will agree to this digital contract and image release prior to the photo session booking, this agreement must be signed and submitted before any session can begin.
APPLICABLE LAWThe laws of England and Wales shall govern this agreement. These Terms and Conditions shall not be varied except by agreement in writing. In the event of any conflict between these terms and conditions (including those relating to the time of payment) and those issued or submitted by the Client and in the absence of any contrary agreement in writing these Terms and Conditions shall prevail.
BOOKING FEE/SESSIONS FEE
A deposit of 50% (1st hour in case of event photography) session fee and a signed copy of this agreement is required to reserve any portrait /wedding/event session date. The remaining balance of the portrait fee is due on the day of the Client’s session and is payable before shooting begins. The Photographer will not hold any dates open without booking fee payment. The proofing gallery (after the session) will be not released if the balance payment is not fulfilled.

CANCELLATIONS & CANCELLATION FEES
The Client may cancel a session at any time but Photographer will keep all money already paid. If you or your children are sick, please give 24 hours notice to reschedule your session. If 24 hours’ notice is not given or the client is a no-show, the session fee will need to be paid again in order to re-book the session. If a newborn shoot that the appointment cannot take place due to premature birth or a bad situation of the mother and/or baby, then of course no costs will be involved. If Client(s) is more than 30 minutes late for your appointment the appointment will be cancelled.

If Photographer cannot fulfill the appointment due to her illness, it will be agreed with you free of deposit fee charge at a different time. If the appointment cannot take place due to a technical problem of the equipment, Paulina Bieleninik Photography will make another appointment with no extra booking fee and give you a 10% discount for this session.
PRICE OF PRODUCTS/FILES
Session fees are include digital images only (JPG/JEPG). The edited digital images will be transferred via download link or email with a print release form. Additional JPEG files can be ordered up to 3 months after the photo shoot for £15 per photo. It is NOT possible to receive the raw or original files. Once digital files have been transferred either via transfer, email or USB they are non-refundable.

All images from portrait sessions and events photoshoots will be delivered via a download link. Portrait photos within 3 working weeks of the date when the photos were picked. Event photography will be delivered up to 2 working weeks after the event date. Wedding photography will be delivered up to 3 months after the ceremony date.

After 3 months from your session/event date, Paulina Bieleninik Photography will no longer be responsible for storing your image files. Client(s) is responsible to make a copy of delivered photos in case of damage or deleting photos.

respect to the photographs that she has taken of myself, my family members and/or my minor child in which may be included with others:
- To copyright the same in the photographer’s name or any other name that she may

conjunction with other photographs, in any medium now or hereafter known, and for any
purpose whatsoever, including (but not by way of limitation) illustration, promotion,
advertising and trade, and;
I hereby release and discharge photographer from all and any claims and demands ensuing from
or in connection with the use of the photographs, including any and all claims for libel and invasion
of privacy.

Photographer is not liable for any damage that has arisen for the other party. Unless there is gross negligence or intent on the part of the Photographer or persons engaged by her. The liability is in any case limited to the amount of the invoice or, if and insofar as there is insured damage, to the amount actually paid out under the insurance. Photographer is not liable for colour deviations or photo prints on products that are not supplied by her. Photographer is not liable for the delivery of less or less good photos than normal due to unforeseen circumstances that are beyond the control of the photographer. Think of children who do not cooperate, instructions that are not followed, weather conditions, illness or injury. The Client understands and accepts that the photographic coverage will be as Photographer professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes. In the unlikely event of total photographic failure or cancellation of the contract by Paulina Bieleninik liability shall be limited to a full refund of all monies paid.

photo session). A print release will be given to Client with digital files to print photos for personal use. The

Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions by parties other than Photographer. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Photographer. A credit line which reads 'Photo by Paulina Bieleninik Photography' in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs and can be used for publication on social networking sites and other websites (e.g. Facebook, Instagram, Twitter, blog, vlog etc.)

Gift vouchers/certificates are only available after contacting and confirmation with Paulina Bieleninik Photography and are valid 365 days after the issue date. Gift cards cannot be returned, they are not transferable too. Gift cards are valid for photo shoot only. A gift card and discount coupons cannot be exchanged for cash. Discount coupons are not valid in combination with promotions/offers. Discount coupons are valid before set up time frames. If you cancel or do not attend your appointment there is no rearrangement and no refunds.

Requirements in terms of props, backdrops, colours or positions will be discussed before the photoshoot. Photographer shall be entitled to use its judgement regarding the style and artistic input in the production of pictures that are meant by booking a session with Paulina Bieleninik Photography you agree to receive the edited pictures with specific, personal to the photographer's style. This includes (but is not limited) to locations, poses and the number of images taken. Due to the willingness of subjects, it may not be possible to capture all the pictures requested or images to the client’s full expectations. In the event of uncooperative children at a session of any kind, for any reason, Photographer may not be able to capture any, or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions.

Standard retouching includes wedding/event photography are limited to white balance, exposure corrections, cropping, styling and other general/basic adjustments. While every safety precaution is taken to minimise risk, by placing a booking Client accepts that Paulina Bieleninik Photography will not be held responsible for any infection of COVID-19 after Clients session of any kind.
